1. Acceptance of Terms

By creating a Nexcure account or using any Nexcure service (including the Niramaay AI), you agree to be bound by these Terms of Service. If you do not agree, please do not use our platform.

We may update these Terms from time to time. Continued use of Nexcure after updates take effect constitutes acceptance of the revised Terms.

2. Eligibility

• You must be at least 18 years old to create a Nexcure account, or have a parent/guardian's consent.
• Doctor and Clinic accounts require valid medical credentials, which Nexcure reserves the right to verify.
• You may not create an account if you have been previously banned from the platform.

3. Account Responsibilities

You are responsible for maintaining the security of your account:

• Keep your password confidential and do not share your account credentials with others.
• Provide accurate, truthful information when registering and using the platform.
• Notify us immediately at security@nexcure.health if you suspect unauthorized access.
• You are responsible for all activity that occurs under your account.

4. Niramaay AI — Limitations

Niramaay is an AI-powered health companion, not a licensed physician. By using Niramaay:

• You acknowledge that AI responses are informational and not medical diagnoses.
• You agree to seek professional medical advice for any health concerns that require diagnosis or treatment.
• You understand that in emergencies, you should contact emergency services (call 112 in India) and not rely on Niramaay.
• You accept that AI accuracy is not guaranteed and may reflect limitations of the underlying model.

5. Prohibited Conduct

You may not use Nexcure to:

• Impersonate any person or entity, including medical professionals.
• Upload false medical information or use the platform for fraudulent purposes.
• Attempt to reverse-engineer, hack, or disrupt any part of the platform.
• Use Nexcure for any unlawful purpose or in violation of any applicable laws.
• Scrape, harvest, or collect data from other users without consent.

6. Intellectual Property

All content, trademarks, and technology within Nexcure are the property of Nexcure Technologies Pvt. Ltd. and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

You retain ownership of health data you provide, and grant Nexcure a limited license to use it solely for delivering our services to you.

7. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice where possible. You may delete your account at any time from account settings or by contacting us.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Nexcure shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the platform. Our total liability shall not exceed the amount you paid to Nexcure in the 12 months preceding the claim.

9. Governing Law

These Terms are governed by the laws of India, specifically the Information Technology Act, 2000, and its amendments. Disputes shall be subject to the exclusive jurisdiction of the courts of Jharkhand, India.
